1. Information About the Service Provider
SfKchan is a privately operated internet platform (imageboard) administered by a private individual based in the Republic of Poland. The service operates under a domain hosted on infrastructure located within Poland or the European Union.
Contact with the administration is possible exclusively through the built-in contact form. The administrator does not publicly disclose personal data within the meaning of Article 13 GDPR.
2. Age Restriction & User Self-Declaration
Use of the SfKchan service is permitted exclusively to persons who are at least 16 years of age. The administrator does not perform active age verification of users. By accessing the service, you independently represent and warrant that:
- you are at least 16 years old;
- you have full legal capacity in your jurisdiction to enter into a binding agreement;
- your use of the service complies with all applicable laws in your place of residence.
Making a false declaration as to your age is solely your responsibility. The administrator, acting in good faith and relying on your self-declaration, accepts no liability for content accessed by individuals who provided a false age. If the administrator has reasonable grounds to suspect a user is a minor, access will be immediately suspended.
3. Legal Status of the Provider — Safe Harbor (DSA / Art. 14 of the Polish Electronic Services Act)
SfKchan operates as a hosting service provider within the meaning of:
- The Polish Act of 18 July 2002 on the Provision of Services by Electronic Means (Dz.U. 2002 nr 144 poz. 1204, as amended), Art. 14 — exemption from liability for stored information;
- The Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on the Single Market for Digital Services (Digital Services Act — DSA), Art. 6 — liability exemption for hosting service providers.
The administrator is not the publisher, editor, or curator of user-generated content and is not liable for such content, provided that upon obtaining knowledge of its illegal nature, the administrator acts expeditiously to remove or disable access to it.
This exemption does not apply if the administrator obtains knowledge of illegal content and fails to act, or if the administrator acted in bad faith.
4. User Responsibilities & Zero Tolerance Policy
By using this service, you bear full responsibility for the content you publish. You acknowledge and agree that:
- You are solely responsible for any content you post, upload, or transmit;
- Your content does not violate any applicable laws or regulations;
- You hold all necessary rights, licenses, and permissions for any material you submit;
- You will not impersonate any person or entity or otherwise misrepresent your identity.
The following content is strictly prohibited and may be subject to immediate reporting to law enforcement:
- Child Sexual Abuse Material (CSAM) or any exploitation of minors — Art. 202 of the Polish Penal Code;
- Content promoting totalitarian systems, fascism, Nazism, or inciting hatred based on race, ethnicity, nationality, or religion — Art. 256 & 257 of the Polish Penal Code;
- Public incitement to commit crimes or glorifying criminal or terrorist activity — Art. 255 & 255a of the Polish Penal Code;
- Criminal threats directed at specific individuals — Art. 190 of the Polish Penal Code;
- Doxxing — i.e. the deliberate publication without consent of any person's private identifying information, including but not limited to: full name, home address, phone number, email address, workplace or school, family details, or photographs enabling identification. Any act of doxxing will result in an immediate permanent ban, removal of all associated content, and handover of connection logs to law enforcement without hesitation — Art. 190a §1 & §2 of the Polish Penal Code, Art. 107 of the Polish Personal Data Protection Act;
- Cyberbullying, stalking, or systematic harassment of any individual or group — Art. 190a of the Polish Penal Code;
- Content that infringes upon a person's personal rights (image, reputation, privacy) — Art. 23 & 24 of the Polish Civil Code;
- Disinformation or false alarms capable of causing public panic — Art. 224a of the Polish Penal Code;
- Advertising, spam, or unsolicited commercial communications in violation of the Polish Electronic Services Act;
- Content infringing the intellectual property rights of third parties, including copyright and trademarks — Polish Copyright and Related Rights Act of 4 February 1994;
- Promotion or facilitation of the distribution of illegal substances, weapons, or contraband.
5. Content Moderation — Human & AI
SfKchan operates a two-layer moderation system to maintain a safe and law-compliant platform:
- Human Moderation: The service is actively moderated by the Administrator (site owner) and appointed human moderators. Moderators are empowered to remove content, ban users, and take any action necessary to enforce these Terms and maintain order on the platform.
- Automated AI Moderation: The service uses artificial intelligence (AI) tools to assist with content moderation. The AI system may automatically flag or hide potentially violating content for review by human moderators. An automated AI flag is not a final decision and is always subject to human review.
Neither moderation layer guarantees that all illegal or policy-violating content will be detected and removed immediately. Users retain the obligation to report violations using the Report Form.
Moderation actions (content removal, bans) are carried out at the sole discretion of the administration and are not subject to appeal through any external mechanism. Users may submit appeals to moderation decisions exclusively via the contact form.
6. Personal Data Protection — GDPR
The administrator of personal data within the meaning of Regulation (EU) 2016/679 (GDPR) is the owner of the SfKchan service.
6.1 Data We Collect
- IP Address — logged automatically with every HTTP request (necessary for security and legal compliance purposes);
- Source Port (Remote Port) — logged with every post to enable unambiguous identification of users, particularly those behind carrier-grade NAT (CGNAT) used by telecommunications operators;
- User-Agent Header — information about the browser, operating system, and device used to connect;
- Anonymous Identifier (#ID) — a unique daily identifier generated from the IP address, assigned to every anonymous post;
- Timestamps — date and time of every post or action;
- Account Data (if applicable) — username, email address (provided voluntarily), avatar;
- User Content — posts, threads, and images submitted by the user;
- Session Cookies — strictly necessary for service operation only; no advertising profiling.
6.2 Legal Basis for Processing
- Art. 6(1)(b) GDPR — performance of a contract (providing the service);
- Art. 6(1)(c) GDPR — compliance with a legal obligation (e.g., cooperating with law enforcement);
- Art. 6(1)(f) GDPR — legitimate interests of the administrator (site security, preventing abuse).
6.3 Retention Period
Connection logs (IP address, source port, User-Agent, anonymous identifier) are retained for a maximum period of 12 months, unless a legal obligation (e.g., criminal proceedings) requires longer retention. Account data is retained until account deletion or withdrawal of consent.
6.4 Your Rights Under GDPR
You have the right to: access your data, rectification, erasure (right to be forgotten), restriction of processing, data portability, and the right to object. You also have the right to lodge a complaint with the President of the Personal Data Protection Office (UODO) — uodo.gov.pl.

6.5 Third-Party Data Sharing
Your data is not sold or shared with third parties for commercial purposes. Data may be shared with:
- Technical infrastructure providers (e.g., Cloudflare, Inc.) solely to the extent necessary for service delivery and under appropriate data processing agreements;
- Law enforcement authorities and courts — solely upon receipt of a valid court order, prosecutor's demand, or other legal obligation. Where not prohibited by law, the administrator will endeavor to notify the affected user.
7. Anonymity and Logging — Warning
Posting as "Anonymous" is a display feature only, not a guarantee of privacy or untraceability. For every post — whether anonymous or from a registered account — the system records and persistently stores the following data:
- Connection IP address;
- Source port of the connection (Remote Port);
- User-Agent header (browser, operating system, device);
- Unique daily anonymous identifier (#ID);
- Precise timestamp (date and time accurate to the second).
This data is sufficient, in combination with telecommunications operator logs, to unambiguously identify the natural person behind every post, including when using shared IP addresses behind Carrier-Grade NAT (CGNAT). Network infrastructure providers (such as Cloudflare) maintain their own independent access logs.
In the event that a user submits strictly illegal material, the administration will immediately preserve all associated connection logs and proactively hand them over to the Polish Police (Policja), the Prosecutor's Office, and relevant cybersecurity authorities (e.g., CERT Polska) without hesitation. True anonymity is not guaranteed. Do not use this site for illegal activities.
8. Reporting Violations, Copyright Infringement & DSA Compliance
In accordance with Art. 16 of the DSA, a mechanism for reporting illegal content is provided. If you believe any content violates the law, intellectual property rights, or these Terms, please use the Report Form.
A formal copyright takedown request should include:
- A description of the rights allegedly infringed and the legal basis;
- The exact location (URL) of the disputed content;
- Your contact information;
- A statement that the report is made in good faith and under penalty of liability for false statements.
The administration will promptly review the report and take appropriate action. Abuse of the reporting system (false, harassing, or mass reports) will result in an immediate and permanent ban.
9. Right to Moderate, Restrict Access, and Terminate Service
The administration reserves the right to:
- Remove or censor any content, thread, or board without prior notice;
- Block or permanently ban any IP address or user account;
- Terminate or suspend the service at any time;
- Modify, expand, or restrict the functionality of the service.
Use of this service is a privilege, not a right. You are not entitled to host your content on a privately owned and operated server under the banner of "freedom of speech". Freedom of expression guarantees under the EU Charter of Fundamental Rights and the Polish Constitution apply in the relationship between the individual and the state, not between the individual and a private platform operator.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ADMINISTRATION SHALL NOT BE LIABLE FOR:
- Any direct, indirect, incidental, special, or consequential damages arising from the use of or inability to use the service;
- Content published by users;
- Loss of data due to server failures or unauthorized access by third parties;
- Any temporary or permanent unavailability of the service.
This limitation does not exclude liability for damage caused by wilful misconduct or gross negligence of the administrator, nor does it affect consumer rights arising from mandatory provisions of Polish and EU law.
11. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising from or related to the use of this service shall be subject to the exclusive jurisdiction of the Polish courts competent for the administrator's place of business, subject to the mandatory consumer protection provisions of EU law.
Applicable legislation includes, without limitation:
- Polish Civil Code (Act of 23 April 1964);
- Polish Act on the Provision of Services by Electronic Means (Dz.U. 2002 nr 144 poz. 1204);
- GDPR Regulation (EU) 2016/679;
- Digital Services Act (EU) 2022/2065;
- Polish Copyright and Related Rights Act (Dz.U. 1994 nr 24 poz. 83);
- Polish Penal Code (Act of 6 June 1997).
12. Amendments to Terms
The administrator reserves the right to unilaterally amend these Terms at any time. Changes take effect upon publication on this page. Continued use of the service following the publication of changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms regularly.
13. Severability
If any provision of these Terms is found by a court to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
